If you’re going to go through the debt settlement process, you’ll have to decide whether to accumulate the funds on your own or give them to your attorney to keep in his trust account. I think it’s probably best to put the funds in the attorney’s trust account, for several reasons. One reason is that it allows for more flexibility in the settlement process. For instance, once we’ve negotiated a creditor down as low as they’ve said they will go, one of the techniques we use is to say, “We can wire the money to you in 10 minutes if you’ll go a little lower,” and they usually agree. So putting the funds in your attorney’s trust account is probably the best way to go if you want to reach the lowest settlement. Another reason it makes sense to put the funds in a trust account is that you know your money will be safe there.
